CASTLE ROCK, CO – A truck driver accused of hitting and killing a Colorado state patrolman in November is now facing a homicide charge.
Trooper Cody Donahue was standing roadside on I-25 south of Castle Rock when he was fatally struck by a tractor-trailer driven by 41-year-old Noe Gamez-Ruiz. Donahue was killed instantly.
Gamez-Ruiz was initially charged with careless driving, causing death, and failure to yield.
He’s now facing an additional charge of criminally negligent homicide which carries a one-to-three year prison sentence.
