Developer sueing city of Colorado Springs

A company out of Nevada that develops apartment buildings and commercial space is suing the city of Colorado Springs for voting against its proposal for building new apartment on the west side. Many Mountain Shadow residents were opposed to the plan presented by the company 2424 G-O-T-G. They wanted to build more than 400 apartments near Garden of the Gods and 30th street. Mountain Shadow residents did not like the idea, saying the additional people and traffic could hinder evacuations in case of an emergency. City Council voted 5-4 against a measure that would have re-zoned the property, in essence giving the developer permission to build. Company lawyers say city officials, including the chief of police, the fire chief and others showed no concerns over possible congestion in an evacuation, but city council allowed neighbors to take up that argument.
