The Gazette is reporting the 10th U.S Circuit Court of Appeals in Denver has upheld a lower court ruling, dismissing a lawsuit filed against Colorado Springs police by a man who was paralyzed after stealing a car and being chased by authorities. Jacob Root was driving a stolen car in May of 2022. Police stopped the vehicle. Root tried to run and was brought down by a taser. He would fall and break his neck and is now paraplegic. Roots’ lawsuit claimed the use of the taser violated his constitutional rights. A lower court ruled the officer’s use of force in stopping root was justified, and that ruling was upheld by the 10th Circuit Court.
