DA says ‘no charges’ in deadly road rage shooting incident

COLORADO SPRINGS, CO – No charges will be filled against an 80-year-old Colorado Springs man who shot and killed a 23-year-old assailant at a Taco Bell last month.

District Attorney Dan May determined the shooting was justified as an act of self-defense, the result of an apparent road rage incident.

Jack Rogers says Jesse Garcia was ‘tailgating’ him near South Nevada and Brookside.

Security footage shows Garcia lunging into Roger’s car window. He was shot in a struggle over Roger’s gun.

Investigators uncovered a previous road rage incident involving Garcia from last year.
