EL PASO COUNTY, CO – An attorney for former El Paso County Sheriff Terry Maketa says an indictment accusing the ex-officer of extortion, official misconduct and other crimes is fatally flawed.
Maketa, former Undersheriff Paula Presley and former Sheriff’s Commander Juan San Agustin were indicted on charges including false imprisonment and kidnapping as well as extortion and misconduct.
Their attorneys plan to challenge the way a grand jury was conducted when it returned the indictments, as well as question whether the evidence is sufficient.
The judge gave defense attorneys until October 3rd to file motions challenging the charges. Prosecutors have until October 14th to respond.
