Man Acquitted of Murder in Colorado Springs

A Colorado Springs man has been acquitted of a murder charge under the Colorado’s Make My Day law.

29 year old Patrick Rau was charged in the shooting death of a homeless man who was sleeping in his apartment basement last year.

A judge ruled Friday that Rau was protected under a law that allows a person to use deadly force if an intruder enters a home illegally and is reasonably believed to intend to harm.

The shooting happened near Platte and Wahsatch.  Prosecutors plan to appeal the ruling.
