A child sex offender who was mistakenly released from jail will be going to trial.
46-year old Michael McFadden pleaded not guilty to charges of failing as a sex offender in El Paso County and his trial will begin in October.
In 2015, he was convicted of multiple sexual offenses against children and was sentenced to 300 years in prison.
However, he was set free because of a legal technicality in February after the Colorado Court of Appeals ruled his right to a speedy trial was violated.
The trial will determine if he still has to register as a sex offender even though one of his previous convictions was overturned.
