The 4th Judicial District Attorney’s office says it will appeal the vacated order in the Deborah Nichols case. The Colorado Springs woman was found guilty of 3 counts of 1st degree murder in the deaths of her 3 children in 2003. They died in a house fire that prosecutors say was intentionally set by Nichols and her husband. In April a judge determined the prosecution suppressed evidence in the case. He ordered the case vacated and the conviction was dismissed. 4th Judicial District Attorney Michael Allen said his office is appealing that order, and if necessary will retry the case. Nicholls hopes to have a bond hearing later this month.
